The following map provides a snapshot of the U.S. landscape of state delivery sales regulations of commercial tobacco products. It contains information based on a survey of current state statutes regulating tobacco product delivery sales in the 50 states, Washington, D.C., and five U.S. territories. The information addresses the following areas:

• Products Covered: This identifies products covered by the delivery sales restriction or prohibition and notes if a state prohibits the sale of flavored tobacco products.
• Delivery Sales Permitted?: This also includes exceptions (e.g., premium cigars exempt from delivery restrictions).
• Age Verification: This includes only those age verification requirements that are part of a delivery sales statute.
• Packaging Requirements: This includes container label requirements and related restrictions such as child-resistant packaging when part of a delivery sales law.
• Retail License Required?: This includes information beyond delivery sales statutes, namely, whether a state requires a license for tobacco retail sales in general. Note that a license may be required for some but not all tobacco products.
• Penalties: This includes penalties for violating a state’s delivery sales law, but not violations of other laws such as flavor restrictions, minimum legal sales age laws, and licensing requirements. If a state does not have any delivery sales restrictions, we use N/A in the Penalties column.

This map only covers laws at the state and territorial level, not local laws that might address delivery sales. For another picture of these laws, please see our dataset. This map is updated regularly and is current as of November 2025.
