Preemption 101 Toolkit
Commercial Tobacco Control Preemption Resource Page
Preemption occurs when a “higher” level of government eliminates or limits the authority of a “lower” level of government to regulate a certain issue. Often, preemption is used to prevent state and local governments from passing laws or enacting policies that protect and advance public health.
In this 60-minute webinar, attorneys from the Public Health Law Center will provide an introduction and overview of the legal basis for preemption, examples of how it works in practice, and some guidance for public health professionals navigating preemption in their work.
